壹、主席致詞:略

貳、報告事項

案由:擬具「兒童權利公約首次國家報告問題清單作業流程」,

請查照辦理。

說明:

一、依據兒童權利公約(下稱 CRC)施行法第 7 條規定,政

府應建立兒童及少年權利報告制度,於本法施行後 2 年

內提出首次國家報告,其後每 5 年提出國家報告,並邀

請相關專家學者及民間團體代表審閱,政府應依審閱意

見檢討、研擬後續施政。

二、基此,前於 105 年 11 月 18 日發布首次國家報告,並訂

於 106 年 11 月 20 日至 24 日辦理國際審查會議。復按

CRC 首次國家報告國際審查會議流程,國際審查委員會

(下稱委員會)業於 106 年 7 月 6 日提出問題清單,我

國應於 106 年 9 月回復,爰擬具「CRC 首次國家報告問

題清單作業流程」如附件 1,請查照辦理。

決定:洽悉,請秘書組於 CRC 資訊網公告上開流程,請權責機

關及 NGOs 據以配合辦理。

參、討論事項

案由:CRC 首次國家報告問題清單權責分工及回應疑義,提請

討論。

說明:

一、旨揭清單內容對應國家報告章節,分為 8 章,計 87 點,

業初步分工如附件 2,擬逐點確認分工,並就權責機關

回應問題清單疑義進行討論。

二、權責機關請依附件 2 格式,於 106 年 8 月 25 日(星期五)

下班前提供中、英文回復內容。

決議:

一、第 2 章兒少之定義

第 2.2 點:單列法務部,請說明民法以 20 歲為成年年齡

之立法理由,及其自民國 18 年立法以來迄未修正之原

因,其他機關請備詢。

二、第 3 章一般性原則

(一)第 3.2 點:免列行政院性別平等處。

(二)第 3.4 點:改列內政部及立法院,請分別說明是否規

劃成立地方兒童議會及兒童國會。

三、第 6 章基本健康與福利

(一)第 6.1 點:增列本部社會及家庭署,請賡續調查 2007

年至 2011 年兒少預、決算,請本部會計處協助;另

請行政院主計總處提供上開年度之分年總預算,並協

助檢視兒少預、決算之正確性與合理性。調查結果至

遲於國際審查會議前提供委員會。

(二)第 6.3 點:對照國家報告附件 6-1 至 6-19 權責機關,

增列本部社會保險司、社會救助及社工司、統計處及

疾病管制署;並請原住民族委員會補充原住民兒少非

自然死亡人數及死因統計。

(三)第 6.5 點:增列本部護理及健康照護司及國民健康署,

請分別說明護理人員及公衛護士有無接受兒童權利

相關訓練課程。

(四)第 6.12 點:免列原住民族委員會及蒙藏委員會,增列

本部中央健康保險署及醫事司,請說明「全民健康保

險山地離島地區醫療給付效益提昇計畫」(IDS)及各業

管之相關措施。

(五)第 6.14 點:免列行政院性別平等處。

(六)第 6.15 點:增列教育部,請就學校營養午餐補充說明。

(七)第 6.17 點至第 6.18 點:保留,俟國家通訊傳播委員

會、文化部及經濟部下午與會討論。

(八)第 6.20 點:對照國家報告第 231 點至第 234 點及第

238 點至第 239 點權責機關,增列本部社會保險司、

社會及家庭署、中央健康保險署、勞動部、教育部及

內政部,請分就國家報告所列給付對低收入戶之給付

水準進行說明。

四、第 7 章教育休閒與文化活動

(一)第 7.6 點:增列原住民族委員會,請說明業管之相關

措施。

(二)第 7.11 點至第 7.12 點:保留,俟國家通訊傳播委員

會下午與會討論。

(三)第 7.15 點:增列本部社會及家庭署,請提供合作式中

途學校相關數據。

五、第 8 章特別保護措施

(一)第 8.1 點:保留,俟國防部下午與會討論。

(二)第 8.2 點:免列法務部。

(三)第 8.5 點:增列內政部,請說明檢警移送前警察報請

拘提、搜索、偵查等相關程序。

(四)第 8.7 點:增列法務部,請提供本點相關數據,並說

明 2 所矯正學校違紀報告之後續採取措施等。

(五)第 8.8 點:增列法務部,請提供被害人保護之法律扶

助相關資料。

(六)第 8.9 點至第 8.10 點:保留,俟勞動部下午與會討論。

(七)第 8.11 點:增列內政部及本部心理及口腔健康司,請

說明各業管之相關措施。

(八)第 8.14 點:增列內政部、法務部及本部保護服務司,

請說明偵訊過程各業管保護兒童被害人之相關措施。
