1.締約國應尊重本公約所揭櫫之權利,確保其管轄範圍內之每一兒童均享有此等權利,

不因兒童、父母或法定監護人之種族、膚色、性別、語言、宗教、政治或其他主張、國

籍、族裔或社會背景、財產、身心障礙、出生或其他身分地位之不同而有所歧視。

2.締約國應採取所有適當措施確保兒童得到保護,免於因兒童父母、法定監護人或家庭

成員之身分、行為、意見或信念之關係而遭受到一切形式之歧視或懲罰

回應點次:結論性意見第 27 點及第 28 點/第三章不歧視措施A節(48 至 59)

問題現況:金門縣政府教育處拒絕因疫情滯留金門之陸籍生就學,主要是依據《金門縣國民

小學學生學 籍管理要點》第 3 點第 1 款第 4 目(除法令另有規定外,不得有寄讀生、借讀

生、旁聽生、 重讀生。但外籍學生或因發生巨大災變之 在籍學生,經本府核備同意就讀

者,不在此 限。),但書外籍生不含陸籍生,影響兒童受教權,並違反 CRC 不歧視原則為

醫 CRC 施行法第九條規定進行法規檢視,參照首次國家報告第 50 點我國提供兒少之福利與

教育措施,不因兒少、父母或監護人有所歧視及第 57 點無國籍或非本國籍未取得居留、定居

許可之兒少,如有就醫、就學、就養之需要,依《兒少法》第 22 條、《國民教育法》及《弱勢

兒童及少年生活扶助與托育及醫療費用補助辦法等規定,確保享有與本國兒少同等權益。

回應:結論性意見第 11 點/第一章 C 節第 17 點

問題現況:大陸居民可自由行落地簽進入金門、媽祖、澎湖,造成跨國婚姻、二婚、兒童跳

機等問題。 日前在金門有一案例,有自由行兒少,因疫情無法返回大陸,依金門地方自治

法卻不能於金門 就讀,影響其受教權。教育部,陸委會及金門縣政府教育處的自治法相關

法令都有違反 CRC 之虞。

回應:結論性意見第 33 點/第三章 A 節第 60 點 ●第四章 A 節第 91 點

問題現況:去年金門有小孩被老師掐脖子,因為離島地區對老師的教育宣導不足,導致輿論

成為孩子太壞、老師很認真,使孩子與家長遭受公審。建議 CRC 教育宣導,應針對離島與

偏鄉特別加強。

金門案例,校長讓孩子入學,但健康檢查時因無法接種疫苗,被教育處發現逾期居留。建議

醫療應不分國籍,另離島偏鄉 地區也要進行 CRC 縣市報告。

回應:結論性意見第 12 點

協調 12. 委員會欣見設立協調與推動兒少福利及權益保障政策的團隊,也 3 欣見行政院設

立兒童及少年福利與權益促進小組。委員會建議政府確保上開團隊以及小組具有充分的權

力,並配有足夠的人力和 財力資源,以執行職務。

意見:建議地方地府各單位也要了解 CRC,某些地方自治法規違 CRC 需要再全面檢視。

回應:第一章 一般執行措施 F.國際合作

意見:在國際合作之下,兒童應視為世界的資產,不應因其國籍受到歧視,因此在研訂法規

時,區分兒童來自對岸或是其他國家並不適當,且 CRC 是特別法應優於國內法。

問題分析:

1.CRC 一般民眾及政府機關甚至教育單位,普遍性觀念不足,政府應該加強宣導

2.金門.媽祖.澎湖地區開放大陸可以落地簽,但對 CRC 並無其它配套措施,將來金門這種案

例只會越來越多

3.偏鄉地區政府機關及很多學校觀念不足,導致無法確實檢視法規,仍違反 CRC 法規

4.沒有落實 CRC 宣導及執行。

5. 結論性意見第 27 點及第 28 點/不歧視措施,主席提到請國教署協助了解,研議是否可

以專案協助,結果為何,政府負責 CRC 部門,是否有落實追蹤了解。

6.金門案例,因為金門地區大多民眾對 CRC 不了解,導致提醒金門縣政府教育處重視 CRC 相

關施行細則的民眾遭網路霸凌,還有被教師體罰的學生及家長再次被網路霸凌二次傷害。

具體建議:

1.可以宣導小影片放電視廣告時段,可以讓老女老少時時看到。

2.鼓勵各聯盟(協會)研擬推行實施計畫,給予獎勵或者補助。

3.政府機關員工及學校教職員及學生,每年需上 CRC 相關課程 12 小時。

4.政府宣傳 CRC 成效除了統計參與人次和辦理場次外,建議執行方式採用有效得知參與者需

求回應程度,並對需求族群提供個別化服務。

5.增強權責機關與民間團體參與及溝通機制,公開中長程計畫,對民眾發布各項政策時,運

用多重管道提供資訊予相關民間團體。

6.針對大陸地區人民赴金門.媽祖.澎湖地區落地簽證,針對兒童部份需要再謹慎評估。

7.法規須全面檢視,尤其對於離島及偏鄉部分,負責 CRC 權責機關更因主動去了解,及使用

問卷調查方式了解民眾對 CRC 的認知程度。

8.中央及縣市權責機關部門單位須嚴格實行,除了國家報告邀請 NGO 參與之外,縣市每年

應做縣市審查報告也應邀請 NGO 共同參與審查報告,偏遠地區及離島權責機關更該到與會

關心了解必且協助。

A Parallel (Shadow) Report on the Second International Review of Civil Participation of the

Convention on the Rights of the Child

I. Report Title: Basic Concept Advocacy & Comprehensive Review of Regulations

II. Related Provisions:

Convention on the Rights of the Child (CRC) Article 2

1. States Parties shall respect and ensure the rights set forth in the present Convention to each

child within their jurisdiction without discrimination of any kind, irrespective of the child's or

his or her parent's or legal guardian's race, color, sex, language, religion, political or other

opinion, national, ethnic or social origin, property, disability, birth or other status.

2. States Parties shall take all appropriate measures to ensure that the child is protected

against all forms of discrimination or punishment on the basis of the status, activities,

expressed opinions, or beliefs of the child's parents, legal guardians, or family members.

Corresponding Points: Concluding observations on articles 27 and 28/Chapter 3: Non-

discrimination Measures, Section A (48-59)

Current Issue: The Kinmen Department of Education rejects students from Mainland China who

are stranded in Kinmen due to the pandemic to return to school. Based on the Regulations on

Student Status Management of Kinmen Primary School Article 3 Subsection 1 Item 4 (Unless

otherwise stipulated by law, there shall be no inbound students, exchange students, guest

students, and repeat students. However, foreign students or current students who have undergone

a major catastrophe with the approval of the government are not subject to the restrictions).

However, foreign students do not include mainland Chinese students, which affects children's right

to education and violates the principle of non-discrimination of CRC. Regulatory review in

accordance with Article 9 of the CRC Implementation Law, referring to the First National Report

Article 50-The welfare and education measures for children in Taiwan do not discriminate against

children, parents or guardians and Article 57- If children in stateless or non-permanent residence

status need medical treatment, education, or care. Based on the Protection of Children and Youths

Welfare and Rights Act Article 22, the Primary and Junior High School Act, and the Regulations for

Subsidizing Life Assistance as well as Nursery and Medical Expenses of Disadvantaged Children and

Youth, all children are ensured to have equal rights.

Feedback: Concluding Remark No. 11/Chapter 1, Section C, Point 17

Current Issue: Mainland Chinese residents enter Kinmen, Matsu, or Penghu with permit on arrival

has created cross-national marriage, second marriage, and illegal minor immigrant issues. There

was a case in Kinmen, children on independent travel couldn’t return to Mainland China due to the

Pandemic. The organizational autonomy regulations of Kinmen County restricted them to study in

Kinmen, which affected their right to receive education. There is a concern of violating CRC in

related regulations of the Ministry of Education, the Mainland Affairs Council, and the Kinmen

County Department of Education.

Feedback: Concluding Remark No. 33/ Chapter 3, Section A, Point 60; Chapter 4, Section A, Point

91

Current Issue: A child was strangled by a teacher in Kinmen last year. The shortage of advocacy of

education for teachers on offshore islands led the public made harsh comments on the child, but

positive comments on the teacher. Both the child and the family suffered from the negative public

opinion. It’s suggested that CRC education and advocacy should be particularly highlighted for

offshore islands and remote villages.

Feedback: Concluding Remark No. 12

Coordination 12. The Committee welcomes the establishment of a team to coordinate and

promote policies for children's welfare and rights protection, and the establishment of

the Child and Adolescent Welfare and Rights Promotion Group by the Executive Yuan. The

Committee suggests that the government ensures the team and the group have adequate powers

and are equipped with sufficient human and financial resources to carry out their duties

Opinion: It is recommended that every local government unit shall understand CRC. There is a

need for a comprehensive review of local government autonomy regulations that violate CRC.

Feedback: Chapter 1 General Reinforcement Measures F. International Cooperation

Opinion: Under international cooperation, children should be recognized as the assets of the world

and should not be discriminated against their nationality, therefore, when formulating laws and

regulations, it is inappropriate to distinguish children from across the country or other countries,

and CRC is a special law and should take precedence over all other domestic law.

Analysis:

1. The general public, government agencies and even educational institutions have

insufficient concepts of CRC, and the government should increase publicity.

2. Visa on arrival of Kinmen, Mazu, and Penghu areas are open to Mainland Chinese, but

there are no supporting measures for CRC. More cases like Kinmen cand be foreseen in the

future.

3. The inadequate concepts of government agencies and schools in remote areas have made

it difficult to evaluate legal compliance, and the violation of CRC regulations.

4. Failure in promoting and implementing CRC regulations.

5. Concluding Remark No. 27 and 28/Regarding non-discrimination measures, the chairman

mentioned requesting the National Education Administration whether the assess can be on

a case-by-case basis. What is the result? Whether the government department responsible

for CRC has followed up its implementation.

6. Kinmen Case-Because most people in Kinmen do not know about CRC, people who restated

CRC implementation to Kinmen Department of Education were bullied online, and the

student who was corporally punished by the teacher and parents were harassed by

cyberbullying again.

Recommendations:

1. A short promo video can be run during TV commercials, which can be viewed by elderly

and children from time to time.

2. Encourage alliances (associations) to develop and execute implementation plans, and give

rewards or subsidies.

3. Government employees, school staff and students are required to take CRC-related courses

for 12 hours each year.

4. Besides counting the number of participants and sessions handled by the government to

publicize the effectiveness of the CRC, it is suggested to apply the effective implementation

method to know the feedback of the participants, and provide individualized services to the

groups in need.

5. Enhance the mechanism of participation and communication between authorities and civil

society organizations, publicize med-term and long-term plans, and use multiple channels

to provide information to relevant civil organizations when releasing various policies to the

public.

6. Regarding the visa on arrival for people from Mainland China to Kinmen, Mazu, and Penghu

areas, children visa need to be carefully evaluated.

7. The laws and regulations must be comprehensively reviewed, especially for the offshore

islands and remote villages. The authorities responsible for CRC will take the initiation and

use questionnaires to understand the public awareness of CRC.

8. The authorities of central government and county and city governments must strictly

implement the law. In addition to inviting NGOs to participate in the National Report,

counties and cities should make annual review reports and invite NGOs to jointly

participate. The authorities in remote areas and offshore islands should attend and

support.
